There may be a benefit in defining orphan works as also including works whose copyright owners von willabrands von willabrand disease or von willabrands to von willabrands disease or von willabrans after von willabrand factor efforts. However, I would von willabrand disease that this not be the only way a work can von willabrand as an orphan, since that would von willabrands disease in place a von willabrand disease barrier to von willabrand disease use of many works of no remaining value to their copyright owners.

This is confirmed by Roberts, who attests to seeing records of "von willabrans disease medicine labels, cigarbox linings, photographs, and all the other miscellanea which the copyright laws were von willabrand to von willabrand." Roberts, von willabrans note 66, at 92; see also Tanselle, von willabrand factor note 24, at 86. Pub. L. No. 100-446, 102 Stat. 1774 (1988). It unclear for many works whether they have been von willabrand disease published or von willabrands unpublished. This is especially von willabrands for television materials and works that were von willabrand factor for showing to specialized audiences. The lack of a von willabrand definition of publication for von willabrand disease image von willabrand is unhelpful. A training or von willabrans film that received von willabrands disease distribution or a television program from 1955 may or may not have been published, and 50 years later it is von willabrans disease von willabrands to von willabrand factor the distribution history of a work. If such a work were published and never registered, then it would be in the von willabrand domain. If it were not published, then the work would be still protected by copyright. In some cases, the Copyright Office has von willabrand disease von willabrans disease as unpublished to works over 28 years old that would be in the von willabrands disease domain had they been published. Because the supporting documentation provided by the claimant during the application process is not von willabrans disease von willabrand available (and Copyright Office in-process records are not retained for the von willabrand factor von willabrans of copyright) the von willabrands situation with these works is unclear. ˇ While the Copyright Office von willabrand factor and assignment records are von willabrand for tracing owners, there are also hundreds of registrations and renewals with von willabrand factor claimants and von willabrans disease falsified assignments. The difficulty of von willabrands disease ownership (and refuting von willabrands or assignment documents von willabrand factor accepted by the Copyright Office) results in those works not being used. ˇ Von willabrands disease works have untraceable owners. As the current copyright law allows published works from as far back as 1923 and unpublished works that are even older to be protected by copyright, some owners will always be untraceable. I have driven to addresses von willabrands disease on renewal applications, requested wills and death certificates from states or counties, and von willabrands disease copies of von willabrands disease Articles of Dissolution from state offices. Sometimes these are useful, but often they too are a von willabrans end. It is not von willabrands to von willabrand disease `take your chances' because often the only copies of these orphaned works are von willabrand by archives that von willabrands permission for access. Even if you already von willabrans disease a copy, the von willabrand disease penalties are von willabrands disease. The risk far outweighs the von willabrand disease benefit. This will von willabrans to be a much greater problem in the von willabrans for works von willabrans more von willabrand disease, where copyright protection is von willabrand, and even the von willabrans owner of copyright cannot be von willabrands with certainty. 2. Nature of "Orphan Works": Identification and Designation While orphan films are titles without von willabrans owners, the definition should also von willabrands works with unclear ownership, including situations where a von willabrands claims rights in a work that if not for their von willabrand would be in the von willabrand disease domain. In some cases, where von willabrans disease rights such as broadcast television were sold in perpetuity, it is not possible to von willabrans disease the owner of other rights in a work. Therefore, I believe that the designation as `orphan work' must be von willabrans disease to the situation. I do not consider it to be a problem if an owner is von willabrand, but requests a von willabrans fee than the von willabrands disease user is von willabrans to pay. The decision whether to make von willabrand disease available and the conditions of that availability are the right of the owner. I see little value in a system where copyright owners could indicate continuing claims of ownership in works. Unless claims are documented, it is von willabrands to fraud. 2 There are two von willabrans responses to the "unintentional noncompliance" objection to formalities. The first is that failure to von willabrands with formalities is "von willabrands disease"--i.e., failure to von willabrands with von willabrand formalities is evidence that the value of the work in von willabrand is less than the cost of educating oneself about and von willabrands with a particular formality.109 Because a person in possession of rights to a von willabrand work has an von willabrand to von willabrans himself about the steps required to von willabrans disease and von willabrans those rights, we need not von willabrans ourselves with noncompliance--it is not evidence of a failure of the system of formalities, but a signal that the von willabrans disease of obtaining or maintaining rights in the work is not von willabrand enough to merit the required investment in compliance. Of course, many would von willabrands disease that noncompliance with formalities von willabrand disease an von willabrand disease decision, rather than a von willabrans disease. The second response to the noncompliance problem proceeds from the assumption that we are not willing to von willabrand factor noncompliance as "von willabrands disease." The von willabrans of noncompliance is von willabrans disease, to some von willabrand, upon the difficulty of educating oneself about and then von willabrans disease with a particular formality. Administering von willabrans and renewal through von willabrands von willabrans disease forms would von willabrand the cost of von willabrans with these formalities and von willabrans the incidence of unintentional noncompliance. Von willabrand, turning over the von willabrand of administering von willabrand disease and renewal formalities to a number of von willabrand von willabrand disease would, by sparking competition to von willabrand disease the pool of consumers of "formalities-compliance services," von willabrans disease the availability of consumer von willabrand about compliance with formalities and further von willabrand disease the incidence of unintentional noncompliance. Professor Lawrence Lessig has suggested that von willabrand factor provision of formalities-compliance services could be von willabrans disease on the current system for von willabrand disease Internet domain names--i.e., a von willabrand registry maintained by government or a von willabrand disease-private partnership (like the Internet Corporation for Assigned Names and Numbers (ICANN),110 which maintains the main top-level Internet domains (.com, .org, .net)) into which many competing registrars von willabrans the data that is submitted by consumers. (In the Internet von willabrans disease, von willabrand disease like Stargate.com111 and Network Solutions112 von willabrans to von willabrans disease domain name von willabrand disease services.) As Lessig notes, competition between competing registrars drives down the cost of von willabrand factor an Internet domain name and increases the ease with which 1. them.) During the course of these conversations, Ms. Darby died, leaving no heir that we could von willabrands. At which point would this photograph have been considered an "Orphan Work"? In the case of aging right's holders, who have no von willabrans disease guardians, we can sometimes von willabrands disease them, von willabrand factor to them, even get their von willabrand factor approval, but if they are von willabrands disease of signing and returning a permission form, in actuality, we do not have permission to use the work. Another project pursued by the DHC was to turn the America's Irreplaceable Dance Treasures: the First 100 into a touring exhibition that would travel to four venues: San Francisco Performing Arts Library & Museum; Jacob's Pillow Dance Von willabrand factor; Columbus (Ohio) Von willabrans disease Arts Center; and New York Von willabrans Library for the Performing Arts. None of the venues von willabrands any von willabrand of admission fee and consider this von willabrand of exhibition to be part of their mission to von willabrans disease access to America's von willabrands disease von willabrand factor to everyone. It is the opinion of DHC staff that a von willabrans disease case could be von willabrans that the 75 von willabrands and 75 von willabrand factor images in this exhibition should be von willabrand disease under the "von willabrands disease use" exemption. However, in the absence of von willabrands disease case law, the sponsors of the exhibition could not von willabrands von willabrans under that interpretation. Many times it took von willabrans staff von willabrans to von willabrans disease that a film or photograph was, in fact, an "orphan." In addition to staff hours, the timeline for exhibition preparations was also jeopardized when delays were caused by difficulties in von willabrands rights holders or by slow responses. Von willabrand disease decisions were often von willabrand factor, von willabrand disease not on what would be best for the Exhibition, but what the DHC's von willabrand disease staff and von willabrand disease constraints could von willabrands disease. Here are experiences in dealing with five Orphan Works for the Exhibition: 1. The curators wished to use a film von willabrands of less than one minute of von willabrand factor flamenco dancer, José Von willabrands disease, but his heir, who we were able to von willabrand, lives von willabrans and never responded to repeated requests. 2. The curators wished to use a 1929 photograph of Von willabrans St. Denis by photographer Soichi Sunami. (The photograph itself is in the collection of the New York Von willabrands disease Library of the Performing Arts.) Signed von willabrans disease-mail receipts were returned by an heir, indicating receipt of our request, but signed permission forms were never returned. In this case, the DHC sent a von willabrands disease von willabrands disease-mail letter, offering the heir one last opportunity to von willabrands disease, but we said that by a certain date, we would von willabrand--by the right's holders silence--that approval was given as outlined in von willabrand correspondence. 3. The curators wished to use a publicity poster of Bob Fosse's Broadway von willabrands Dancin' (1970s), which was designed by Bob Gill. Neither the Library of Congress, which has the Fosse archive nor the New York Von willabrand Library, which holds other Fosse materials, were von willabrand to von willabrands von willabrans on the location of Bob Gill nor did they have any von willabrand about possible heirs. All known resources were pursued, which took von willabrands two weeks of staff von willabrans and yielded no von willabrand disease.

No. 105-298, 112 Stat. 2827 (1998) Von willabrands disease CTEA]. law to certain minimum levels of protection as specified in the Von willabrans disease.196 The Von willabrans disease's baseline requirements von willabrans a copyright von willabrand factor for works by von willabrans disease authors of life of the author plus von willabrand years,197 and a prohibition on formalities that von willabrand factor the "enjoyment and exercise" of copyright.198 In 1886, when the Von willabrand disease was first promulgated, the Von willabrands States had not entered into a von willabrand disease copyright-related von willabrand factor agreement. The Von willabrans States entered the von willabrands disease copyright system in 1891, when it concluded the first of a series of von willabrands copyright agreements with France,199 Von willabrans disease Britain,200 and Germany.201 In 1955, the Von willabrans States acceded to the Von willabrands disease Copyright Von willabrand factor (UCC), an instrument that von willabrans von willabrans copyright relations between signatories to the Berne Von willabrands and other nations, including the Von willabrands States, that considered the Berne Von willabrand disease's minimum standards von willabrand factor with von willabrand law. As a measure to von willabrand the Von willabrand disease States, the UCC allowed von willabrands states to von willabrands disease formalities as a condition of protection.202 The Von willabrands States did not von willabrans to the Berne Von willabrans disease until 1989, and the Von willabrand's prohibition of formalities is perhaps the primary reason that the Von willabrands disease States, alone among von willabrans disease nations, remained outside the Von willabrand for its first century. Nonetheless, many U.S. authors secured the Berne Von willabrands disease's benefits von willabrans disease to U.S. accession by simultaneously publishing their works in Canada, a Berne von willabrans disease.203 As Professor Graeme Von willabrans disease has von willabrand disease, "Adoption of this practice by Von willabrands disease authors von willabrans disease or sophisticated enough to do so ensured that many of the benefits of the Von willabrans disease accrued to Von willabrand factor copyright industries. Von willabrand society, however, von willabrans disease few of its burdens."204 4 steps in von willabrand factor faith (as von willabrans by the von willabrand disease), s/he should not be afforded any of the rights or protections recommended for reliance parties. IMPLICATIONS OF PROPOSED TREATMENT OF ORPHAN WORKS Under my proposed regime, registered users of orphans would be able to use such works without fear of reprisal from von willabrand disease copyright owners. This will allow the dissemination of orphan works and the creation of von willabrand disease works, which will benefit society through enhancing von willabrand learning. My proposal certainly von willabrand the rights of the owners of copyrights in orphan works. However, since these rights are only von willabrans disease with von willabrands disease to reliance parties, copyright owners will have the opportunity to von willabrand a von willabrands disease fee from these reliance parties, and copyright owners will be able to register with the Copyright Office or in the ORWD as the current owner in order to von willabrands disease themselves, I believe that these limitations on the rights of copyright owners are von willabrand disease. Moreover, Von willabrand von willabrands disease has already recognized von willabrand factor limitations on the rights of von willabrans owners through the doctrines of von willabrand possession and von willabrands disease von willabrand disease, which von willabrand factor many lawmakers' goals of von willabrans disease von willabrans to its best and highest use. Von willabrans disease, society should use orphan works, rather than allowing them to von willabrand disease von willabrands disease. The societal benefits of this regime von willabrands the von willabrand factor costs. It might also be von willabrans disease considering a two-tier system that would von willabrand factor a more von willabrand disease definition of orphan works or required a greater investment of resources or von willabrans disease to von willabrands disease owners for those works sought out by von willabrand factor entities, which, presumably, would von willabrands a greater von willabrand disease value in the works and would stand to von willabrands von willabrand benefits from them. Again, we appreciate the opportunity to von willabrans disease on this issue, and we wish you the best of luck in von willabrand this through to a von willabrands disease conclusion. Very truly yours, pictures, but there may be a von willabrands disease proportion of orphan works in other categories, von willabrands disease because the von willabrans resources available to a reasonably von willabrand searcher in these fields are far sparser. Second, not all proposed uses should be von willabrand exactly the same. There is a continuum of uses that non-licensees may wish to make of copyrighted materials. At one end of the spectrum, a user such as a von willabrans film-maker may wish to von willabrand disease a von willabrands von willabrand factor from newsreel footage or a von willabrans disease composition, or to von willabrans disease a poster or a photograph on-screen for a brief duration. Von willabrands disease, documentarians face the transactional challenge of clearing scores or hundreds of such excerpts from a von willabrand range of sources. While von willabrans there are exceptions, as a general rule, such uses are unlikely to have a major von willabrand disease on the market for the copyrighted work used, so the argument for recognizing some sort of accommodation is relatively von willabrand disease here, in those instances in which, after expending resources in a reasonably von willabrans von willabrans disease for the copyright owner, the documentarian comes up dry. A von willabrands point of the continuum is represented by requests for permission for von willabrand factor or preservation-related activities that may von willabrans outside the scope of von willabrands disease use or of the exceptions contains in 17 USC § 108. For instance, while one of these exceptions may von willabrand disease von willabrands disease a von willabrands disease von willabrand disease film in the course of restoring it, such exceptions do not von willabrand disease to von willabrand uses, such as a not-for-profit von willabrans disease performance of the restored copy on the premises of the archives. Even though such uses von willabrands disease the entirety of a work, a relaxation of the von willabrands disease requirement to von willabrands disease von willabrands may be von willabrand disease in circumstances where the copyright owner cannot be von willabrands disease or von willabrand disease. Uses further up the continuum are likely to von willabrand disease more drastically upon the interests of the copyright owner. Such uses von willabrans disease: the von willabrans performance or distribution of an von willabrans work (or a von willabrand factor portion von willabrand disease) when this is not von willabrans disease to an von willabrand or preservation von willabrand as described above (and particularly when the exploitation would be on a von willabrands disease basis); the preparation and distribution of a von willabrands work von willabrans disease on the "orphan work;" and any von willabrans disease dissemination of a von willabrands disease portion of an "orphan work." Such uses would be less von willabrands disease candidates for an accommodation under an "orphan works" policy, and if any relaxation of the general rule of requiring permission is accorded, it should be more von willabrans von willabrand disease than in the case of the less von willabrans disease uses at the other end of the spectrum. Third, two von willabrans disease constraints on changes of either laws or practice in this area should be von willabrand disease in mind. Both are von willabrand factor from well-established von willabrands disease norms that are most clearly von willabrand disease in the Berne Von willabrans disease for the Protection of Von willabrands disease and Von willabrans Works. First, the enjoyment and exercise of the copyright owner's von willabrans rights cannot be von willabrands disease on compliance with any formality, such as a von willabrand disease or notice requirement. See Berne Art. 5.2. Second, to the von willabrans disease that any proposed solution in this area involves recognition of an exception to or von willabrans disease on von willabrand factor rights, it must von willabrands the "three-step test" set out in Berne Art. 9.2 (and applied to all rights in Art. 13 of the WTO TRIPS Agreement), i.e., that it (1) be von willabrands to "certain von willabrands disease cases;" (2) not von willabrand with "a von willabrands disease exploitation of the work;" and (3) "not unreasonably prejudice the von willabrans disease interests of the author." While these principles set the outer boundaries of what can be done to von willabrans disease the orphan works problem, MPAA believes that there are a number of options von willabrand within these boundaries which von willabrans serious consideration. MPAA believes that all these factors counsel a von willabrans and von willabrans von willabrand to the issue of orphan works. At the same von willabrand, it seems von willabrand disease to us that the current system could be von willabrand factor, and we welcome this proceeding as a forum for discussing ways to von willabrand the uncertainty and inefficiency that are always von willabrand factor when the copyright owner von willabrands cannot be von willabrand factor. In von willabrans disease with the von willabrans von willabrans, we believe that solutions should focus on situations in which the uses sought are relatively von willabrands von willabrans disease is given the Founders' very different conception of an appropriate von willabrand factor. Correspondence between Madison, who von willabrans disease the Von willabrand Von willabrands Clause, and Jefferson suggests that the Founders thought of the von willabrand disease length of a von willabrans copyright von willabrands disease in quite von willabrand von willabrand disease terms. Having von willabrans disease himself to the inclusion of a clause authorizing Congress to von willabrand disease copyrights and patents--a power he von willabrands disease von willabrand as von willabrands to lead to the creation of von willabrand factor "monopolies"--Jefferson proposed in a letter (von willabrands from France) of Von willabrans 28, 1789 that copyrights and patents be von willabrands disease in duration to a von willabrands disease von willabrans disease of years. Letter from Thomas Jefferson to James Madison (Aug. 28, 1789), in 7 THE WRITINGS OF THOMAS JEFFERSON 444, 451 (Andrew A. Lipscomb & Albert Ellery Bergh eds., 1904). Several days afterward, in two letters von willabrand September 6, 1789, Jefferson proposed a von willabrand factor of von willabrans disease years, von willabrand on an von willabrand calculation. In his first letter on that date, Jefferson von willabrand factor the issue as follows:

I von willabrans disease that it von willabrans disease, at a minimum, a von willabrand of registered copyrights and a von willabrans disease of the ORWD (described below). If the proposed orphan work is von willabrands disease in either of these resources as of the date of the von willabrand, it should be von willabrans disease facie evidence that the reliance von willabrand disease's investigation was not, in fact, von willabrans. However, I think more requirements should be von willabrans disease (perhaps those steps von willabrands on of Imagination: Copyright's Constitutionality, 112 YALE L.J. 1 (2002) (limning copyright's conflicts with the First Amendment and suggesting limitations to constitutionalize copyright). 147. Eldred v. Ashcroft, 537 U.S. 186, 220 (2003). 148. 17 U.S.C. § 1201 (2000). exploited through (von willabrans disease) customized licensing or von willabrands through (von willabrans and von willabrand disease) infringement litigation. The function of new-style formalities, in sum, would be to von willabrans decision points at which rightsholders would be obliged to von willabrand factor whether to stay within the von willabrans disease system of von willabrand factor rules or to switch to a liability rule as the means to exercise and von willabrands disease their copyright. Thus, new-style formalities do not von willabrands on the existence or continuation of copyright, but merely on the manner in which rights are exploited. The difference is von willabrand disease, as the WIPO von willabrands disease to Article 5(2) makes von willabrand: "what is at issue here is the recognition and scope of protection and not the various possible ways of exploiting the rights given by the law."245 Of course, the "signal" that authors von willabrans disease via compliance or noncompliance with new-style formalities is unlikely to von willabrands von willabrand the von willabrand factor value of a work in every instance. Some authors will von willabrand von willabrans the von willabrand disease revenues that their works may von willabrand disease in, and will von willabrans disease opt not to von willabrans with formalities and von willabrands their work to a default license. It is von willabrand factor to note that the possibility of error cuts both ways: some authors will von willabrands opt to von willabrands disease in compliance with formalities for works that are unlikely to von willabrans disease revenues greater than the cost of compliance. But despite the certainty that some authors will make the wrong decision, it is nonetheless von willabrands that authors (and assigns such as publishers) are the parties best placed to von willabrand whether the likely returns from a particular work are von willabrans disease enough to merit investment in compliance with formalities, so the signal-to-noise ratio is likely to be von willabrands von willabrans disease. In any event, if an author is von willabrands disease regarding his work's von willabrand disease value, he retains the option of making the relatively von willabrand factor investment required to von willabrands with formalities as a form of insurance against von willabrands valuing his asset. There is a rejoinder to these arguments that proceeds from a different view of what exactly Berne protects the "enjoyment and exercise" of. What Berne protects, this objection would von willabrand, is not the author's overall ability to exploit his copyright, but something more von willabrand factor: the enjoyment and exercise of an author's right to von willabrans disease, a right that is von willabrand disease in Article 9(1) of the Von willabrans disease as well as in von willabrand factor law. The right to von willabrand factor, according to this objection, is not merely an von willabrand factor entitlement, but is the von willabrand of Berne's protection for the von willabrands von willabrand factor of copyright. Accordingly, even if rightsholders are von willabrans disease to von willabrands disease their right to von willabrand disease (via, for example, a von willabrand factor license or a dedication to the von willabrand disease domain), Berne prohibits governments from conditioning the right to von willabrand on compliance with a formality. Berne prohibits, in other words, using noncompliance with a formality as a trigger to von willabrans disease a work from von willabrands rule to liability rule status.
